In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable under Saudi Sharia commercial law, UAE federal civil law or EU data regulations, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions of this agreement.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all legal purposes, including outstanding order payments, return obligations and data retention requirements under PDPL/GDPR.

If in our sole judgment you fail, or we reasonably suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without prior notice and you will remain liable for all outstanding payment amounts due up to and including the date of termination; and/or accordingly may permanently deny you access to our website, member account and all shopping Services.

Text messages may be sent using an automatic telephone dialing system or compliant regional marketing technology.

Service-related SMS messages may include order tracking updates, delivery alerts, payment confirmations and account security notifications. Promotional SMS messages may include modest apparel discounts, seasonal sales, new abaya/kaftan collection launches, cart abandonment reminders and exclusive SAR price promotions for Saudi and UAE customers.

You understand that you do not have to sign up for this SMS marketing program in order to complete any purchases, and your consent to receive texts is never a mandatory condition of placing an order with KAFDIA.
